The problem with Cat 'B' is that the insurers can't let you keep the salvage, as it has to go to an environment agency licenced dismantler :(

You may be able to negotiate for some of the part back, though (specifically the upgrades), by removing them at the dismantlers yard :?

That being the case, make a list of all the upgrades that are declared and their prices, as well as the upgrades that would add value to the car but wouldn't affect your insurance e.g. AB cables, Lockwood dials (be careful at that point, remember they could use some of them as excuses for saying you're not covered), then present them with your case that:
a) They've undervalued your car, and you want at least market value plus cost of upgrades/or
b) You want market value and all the bits back that they've not given you credit for, even if you have to go and remove them yourself.
As said before - happy to help wield a spanner.

I wonder if you could argue the case for Cat 'C' just so that you can get it back to strip it at your leisure, based on the fact that the chassis isn't bent, but with agreement that it's never destined for the road again anyway...just a thought.

I'd be surprised if that were an option - a Cat 'B' is awarded to prevent the car getting back on the road, ever.

With a Cat 'C' it can live on, as such, a promise to destroy it carries no weight.

Even if it is well beyond repair (as it looks), the issue is that it could be possible to 'clone' it onto a ringer (unlikely due to the numbers/value of the cars left), but it is a prime consideration of the company - a Cat 'B' stops that ever being an issue :?

If it's cat B, why not offer to have the chassis crushed and the tub cut in half before return to you for parts recovery?

Next time round, consider a guaranteed value for the car. It might save any unforeseen surprises in a situation such as this and it only takes about 5 photo's and a tenner to Club Lotus ;-)

OK, I've spoken to Highway insurance today and the official offer is £7000 and indeed Cat B. They are refusing to budge on the category and also refuse to let me speak with the assessor. I also learned after asking that the car has already been moved to Copart in Sandtoft ready for auction which is probably why they are so adamant that it is staying Cat B.

I've turned down the first offer and am currently putting together my evidence pack which I am sure will lead to further negotiation. I have got copies of all S2's for sale currently on Autotrader and Pistonheads with a nice graph of price against mileage showing average market price. I've also now got a list of recent mods (all declared) and work done with costs including copies of most of the reciepts and invoices. Furthermore I have lots of pre-accident photos of the car which I will be putting in the pack. I have stated with this evidence that as I cannot salvage any parts from the car it will cost nearly £9.7k to get another car to the same standard and therefore that I consider £9k to be a fair settlement.

Anything else I am missing, shall I include copies of things like the previous MOT's etc?

One thing I have considered is to get a couple of statements as to the pre-accident condition of the car to go with the photos, anybody willing to help in that respect would be much appreciated.

I just need to finish putting it together tomorrow and I can get it sent off so any advise on what should and shouldn't be included would be greatfully recieved.

Once it's gone to Cat 'B' you need a DEFRA licence to have anything else to do with it :(

I would suggest sending only coppies of any documents to anyone - always retain originals (until settlemet is reached).

Likewise, keep your spare keys, V5 & MOT which they will ask for.

Final (for now) advice - never send them your original FSH (owners manual) without first writing all accross it in red marker pen something like "Vehicle declared Cat 'B' " and date it accordingly. Otherwise some smart chancer will try and sell it on for a bit of a fortune, encouraging the oportunity to 'ring' another car to the unsuspecting public.

Thats the plan, everything I send for now will be copies.

That could be a problem, the last time I saw that I was dangling upside down from the seatbelt dribbling blood all over it!!. See at least I managed to keep myself entertained whilst waiting for rescue what with listening to the radio and reading the manual  .

When I went back to recover my stuff from the car I couldn't find it so its either still in the woods somewhere, has already been removed or was just wedged somewhere in the car that I missed, the same went for my LEC stickers, Lotus Tax Disc Holder and Tax Disc. Either way I havn't got it now.

The Tax Disc was found by my dad a few days later when he went to clear up another accident (he works for the coucil and was on call-out that week) which happened in the exact same spot, he also found half a number plate and one of my in car chargers.

Sounds like a loss on the owners handbook :( - but the bloodstains may put people off buying it on fleabay

Next bit of advice, get the tax disc sent in to DVLA for a refund of the unused portion (keep a photocopy) - once you accept the payout from the insurance company, the car will become their property and you can't get a refund without the car being registered to you! (£15 a month ain't a fortune, but it's better in your pocket than theirs!)

OK here's another idea - what about seeing if you can get yourself along to the auction with the intent of finding out which breaker the car is sold to?
Then simply phone up and agree prices for all the bits that you want before going along and buying them back.
Chances are they won't know the market value of the upgrades, so you can get your own bits back for less than what you've been paid for them, perfectly legally!
For example, who would phone up for a 2nd hand exhaust? Breaker quotes £100, and then lo and behold, it turns out to be stainless steel but you've already agreed the price.
Furthermore, a lot of breakers don't trust Joe Public to remove only the bits that they say they've come for, so they may even strip 'em for you before you arrive, which even saves you from getting your hands dirty!

Just had the second offer from the insurance of £7650, I'm going to phone them back tomorrow with a decision as I only just caught them with my return call before they shut today.

not got a clue really but the guys whove had cat c write offs have been able to get them back for about £2k
yours is quite a bit beyond that so Id hazard a guess at less £1500???
you'll need to work out what could be salvaged and what its worth...just to make sure you dont go 'over board' with the buy back price

whats toast????
body and chassis.....
everything else if its ok would be probably worth about £3k+ as bits...engine...turbo...wheels...seats....all the mods you added..etc etc etc

just thinking out loud :)

IMHO i wouldn`t pay more than £1000, there`s not much to salvage. Infact i`d give it a miss as it`s just not worth the hassel, unless you`ve got upgrades on there that you want to get back. :?

Body is scrap
Chassis don`t go for much
are all the Wheels damaged?
and parts are not worth as much as they did a few years ago :|

I'm pretty much with Monty on this one, unless there are some very expensive/irreplaceable upgrades I'd let it go and just fight tooth and nail with the insurance co.

We quickly totted up what he'd put on the car and the upgrades came to getting on for £2k.
It doesn't take much - Hi-Specs, Piper, AB Cables, V5 switcher, shortshift...
Then once you start selling things like engine & 'box, rear lights etc it soon becomes worthwhile.
So if it's possible to get all of those parts back for less than £1500 it's well worth doing.
