The Consumer Protection Act 2015 is quite clear in its definitions.

For the Act to apply, there needs to be a 'Trader' and a 'Consumer'......

He is, undoubtedly, a 'Trader' by definition, so the other bit needs to be proven - A 'Consumer' is basically an 'End User', and NOT to be confused with a 'middle-man'.

If the seller claims that he only sells cars on a 'Trade' basis - ie to other 'Traders', then there is no 'Consumer' and the Act doesn't apply...

...it would come down to an arguement as to whether he sold it on to an individual for their own personal use, or for doing-up, breaking apart, or selling-on.

Each case is different, and it would depend on the wording of any contract. If you can show that you bought the car for your own personal use, then he is bound by the legislation and will be responsible for ensuring that it is 'fit for pupose' (the Act allows for 6 months after the sale, with the onus on the Trader to prove it wasn't his fault within this time [and that isn't possible to prove, so they have to pay}, and up to a further couple of years when it becomes percentage-arguable....

Just the one now, but this one's mine! - and it will be finished eventually..... - but also temporary custodian of a project until it is finished enough for Angie to drive it

...oh, and a 2006 Freelander destined for the jungles of The Gambia - 4500 miles across roads, desert and tracks - what could possibly go wrong?

Huh? £5695 but open to offers - says only needs gear selectors supplied with if fitting, new rear window fitting (£120) and missing aerial replacing and it will be worth £10,000.
Suggest he sorts it and asks £10k then ...

Looking carefully past the water droplets I'm pretty sure I can see lacquer coat missing in places... Wondered why he hadn't wiped it dry for the photos..

BRG elan on ebay.

http://www.ebay.co.uk/itm/Lotus-Elan-M1 ... SwtfhYqFz4

i've driven past this elan every week for years and years, on the way to visiting my parents, and from my visual experience, it's always been on the drive in all weathers (never seen it garaged). it has only recently had the shower cap on it, although the cap may have been fitted in past winters. it does look good from the road, but the photos show what its like closer up.

could be a fixer upper for someone. it is located a mile from junction 28 of the M1.

This one looks reasonably priced - £7,990 with 74k miles from a dealer! www.ebay.co.uk/itm/1991-J-LOTUS-ELAN-1-6I-CONVERTIBLE-5-SPEED-162-BHP/132081333099

Mot history looks pretty good - used every year and no horror stories, hood looks recent and it looks Calypso Red, not Pink..

:smt017 that algorithm makes a low mileage car worth less than high mileage .... Isn't it just 'think of a number?'

Listing ended now anyway...

:agree: Depends if you are buying or selling but I've got one on SORN that I ought to sell. Mine is still below 54k miles with the 165bhp engine but hasn't got ABS or airbags ... :smt110 < - is that the correct 'I'm being ironic' smiley ?
