Anyway just to let you know I won it on Copart. Not a hard hit at all no tub damage bottom ball joint separated. They did not used to give reg numbers out I think you might have caught a member of staff who did not know their rules the reason being it is easy to ring a car from a damaged cars details.

I have been a member of copart since back in the day when it was Universal Salvage. Showing my age

Intellectual property is a minefield. A photograph taken by someone is normally considered to be set in stone as their IP, but it cannot be enforced without the warnings as shown above. Even after use, a warning has to be given, and an oportunity to retract.

Only then can a legal case be considered..... and that is before you get into Copyright laws.

In this case, Copyright doesn't come into it (as i would expect any rights to belong to Lotus, not the auction site). If you wish to apply copyright to a photograph it needs to be registered and paid for!

Re-posting an advertising image isn't usually considered to be inapropriate use of IP (as long as credit is given to the author), but who knows what view a Civil Court would come to in this (or any other) case.

Then you have the argument that the IP could belong to the photographer or the company they work for (or the agent who requested/required it to be taken).....

.... but once it gets into the public domain, those rights are somewhat retracted anyway.....

By simply passing on a photo of an item advertised for sale (by Auction in this case), and making it clear that it is such, there is no intention to deprive the author of any rights, or to profit (financially or otherwise) from it. And there is no "loss" to the IP right holder.

However, should you wish to advertise the car for sale in the future, and use the photos for that purpose, it's a different ballgame.

(Oh how I dislike Civil Law - Criminal is so much easier )

What a strange concept, that you might get sued under copyright for publishing a picture that advertises a sale item to a wider audience to the benifit of the individual making the sale!

Its really not bad at all a days work to get it back on the road if I had a front bumper and clam spare. Anyone??
It looks mechanically to have been very well looked after.

I bought it off Copart primarily to stop it being broken for spares it is far too good for that!!

Time to get a grip on reality I think!, I have regularly seen people buy a car on Copart and within a couple of hours its on Ebay with the auction pictures, now something like that might be worthy of looking into!!!!.

Mike, I have often asked for the registrations of cars that I or friends were interested in buying and they have given them at many different Copart sites without any problems, according to Gov figures ringing cars from salvaged ones was in very low numbers, and was one of the main reasons for doing away with the VIC check.

Still think you got a good buy though, looks like it could be put back together without too much outlay, and 75k miles!, Its hardly been anywhere, and the interior corresponds with the mileage as well as it looks immaculate, easily worth what you are asking .

Now that sort of comment will get you in to trouble but on the subject of sexist philosophy I was kinda supportive of wimmin who wanted a tax break on their tampons etc but having been out today for some new razor blades I think if they're successful in their campaign then I shall demand similiar for our shaving rights!
